Welcome to Unicorn Kitchen Industry (“Company”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) govern (A) your use of unicornkitchenindustry.com (the “Website”) and (B) the commercial sale of our equipment and services. By using the Website or placing an order with us, you agree to these Terms.
1) Website Use
- All content (logos, photos, drawings, copy) is our intellectual property or licensed to us. Don’t copy, re-publish, scrape, or resell without written permission.
- Information shown (specifications, prices, availability) is indicative and may change without notice. Final terms are only what’s written in our quotation / proforma invoice.
- Links to third-party sites are for convenience; we are not responsible for their content or policies.
- You agree not to attempt to disrupt, reverse engineer, or misuse the Website or its forms.
2) Commercial Order Terms (Sales)
Unless otherwise agreed in writing on the quotation/PO, the following defaults apply:
- Validity: Quotation rates are valid for 7 days.
- Delivery Lead Time: Typically 15–18 days after order confirmation & advance. Actual schedule depends on scope and parts availability.
- Taxes: GST extra as applicable per law.
- Logistics: Transportation / packing / forwarding / loading / unloading / freight are extra and payable by the buyer (unless stated otherwise).
- Site Work: Any civil/masonry/wooden/electrical work at site is to be arranged by the client at their cost.
- Price Basis: Ex-works, Ex-Delhi (unless specified otherwise in the quotation).
- Payment Terms:
- (A) Imported equipment: 100% advance with confirmed purchase order.
- (B) Customized equipment: 50% advance with PO; balance against Performa/Proforma Invoice before delivery.
- Inspection: Material can be inspected at our works prior to dispatch.
- Jurisdiction: Delhi/New Delhi courts.
- Force Majeure: Orders are accepted subject to events beyond our control (strikes, lockouts, accidents, fire, riots, civil commotion, etc.).
- Installation:
- (a) Customized equipment: Installation charges typically 1.5% + taxes on the total project cost (unless stated otherwise).
- (b) Imported equipment: Installation on actuals as per principal/company charges.
- Specifications: Unless noted, our stainless steel products are manufactured using SS 304 with heavy steel thickness up to 16 SWG (or as per item-wise drawing/BOQ).
- Tolerances & Variations: Minor variation in finish, shade, and dimensions within industry tolerances may occur. Images are for representation only.
- Custom Orders: Made-to-order/customized items are non-cancelable and non-returnable after fabrication begins.
- Title & Risk: Risk transfers on dispatch ex-works; title passes on receipt of full payment.
3) Warranty & After-Sales
- Standard warranty is 12 months from delivery against manufacturing defects, unless a different term is mentioned in the quotation/PO.
- Warranty excludes consumables, glass/ceramic parts, normal wear & tear, improper use, inadequate utilities (gas/electricity/water/ventilation), third-party alterations, and damages during transit or installation by others.
- Service calls are attended during business hours. Spares beyond warranty are chargeable.
4) Limitations of Liability
To the fullest extent permitted by law, our aggregate liability (whether in contract, tort, negligence, or otherwise) is limited to the price paid for the specific equipment/service giving rise to the claim. We are not liable for indirect, incidental, special, or consequential losses (loss of profit, downtime, etc.).
5) Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Subject to the section above on jurisdiction, disputes shall be subject to the exclusive jurisdiction of competent courts at Delhi/New Delhi.
6) Changes to These Terms
We may revise these Terms from time to time. The “Last updated” date will change accordingly. Continued use of the Website or placing orders after changes constitutes acceptance.
